5th graders: the top-40% rule for advanced math

Under Texas Education Code §28.029 (added by SB 2124 in 2023), every district and charter school must automatically enroll in an advanced math course each 6th grader who performed in the top 40 percent on either:

  • the grade 5 state math test, which for this year's 5th graders is the spring 2027 STAAR (April 19-30), or
  • a local measure that includes the student's 5th-grade class ranking or shown proficiency in 5th-grade math coursework.

Parents can opt out. The program is meant to let students take Algebra I in 8th grade. The law sets no cut score: the district decides who falls in the top 40 percent, so ask your school how it applies the rule.

Questions parents ask

When is STAAR 2027?

TEA's 2026-27 calendar sets three spring 2027 windows for grades 3-8: reading language arts April 5-16, grade 5 and 8 science and grade 8 social studies April 12-23, and math April 19-30, 2027. Districts choose the exact days inside each window, so check your school's testing calendar.

Is 2027 the last STAAR test?

For grades 3-8, yes. TEA says the last STAAR administration is spring 2027 for grades 3-8 and December 2027 for end-of-course tests. The Student Success Tool (SST) replaces STAAR from the 2027-28 school year, starting with a beginning-of-year test between August 23 and September 30, 2027.

When do STAAR 2027 scores come out?

For grades 3-8, results go to districts on May 28, 2027, and to the Family Portal on June 15, 2027. Final reports reach the Family Portal on July 22, 2027. Spring end-of-course results reach the Family Portal on June 8, 2027.

Does STAAR still count in 2027?

Yes. Spring 2027 is a full STAAR administration, with results reported to families as usual. For 5th graders, the grade 5 STAAR math test is also one of the measures the law names for automatic placement in 6th-grade advanced math.

What is the top-40% rule for 6th-grade advanced math in Texas?

Texas Education Code §28.029 (from SB 2124, 2023) requires every district and charter school to automatically enroll in an advanced math course each 6th grader who performed in the top 40 percent on the grade 5 state math test, or on a local measure such as 5th-grade class ranking or shown proficiency in 5th-grade math coursework. Parents can opt their child out. The law sets no score number; the district works out who is in the top 40 percent.

When is the last STAAR English II test?

TEA says the final STAAR English II will be given in June 2027 (window June 14-25). English II is not a graduation requirement for students who graduate after August 31, 2027, but students enrolled in English II in 2026-27 still take it.
