By accessing or using iMasterly ("Service"), you ("User," "Parent," "Guardian," or "Student") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must discontinue use immediately.

If you are registering or supervising a minor under 18, you confirm that you are the parent or legal guardian and accept these Terms on their behalf.

These Terms form a binding legal agreement between you and iMasterly LLC, a Texas, USA company.

2. DESCRIPTION OF SERVICE

iMasterly is an AI-powered supplemental educational platform providing content in:

  • Mathematics
  • English Language Arts
  • Finance & Financial Literacy
  • Psychology & Emotional Awareness
  • Communication Skills
  • Spanish
  • History
  • Other general K-12 learning subjects

Important Service Limitations

iMasterly is:

  • NOT an accredited school
  • NOT therapy or counseling
  • NOT medical, psychological, or mental health treatment
  • NOT guaranteed to improve grades or outcomes
  • NOT a substitute for professional educational, financial, or psychological advice

The Service is intended for general enrichment and educational support only.

3. CONTENT SUITABILITY & AGE APPROPRIATENESS

iMasterly provides content designed for students in grades K-12. Some topics—such as emotional awareness, communication, psychology, and social skills—may require parental review depending on a child's maturity level.

Parents and guardians are solely responsible for:

  • Determining whether content is appropriate for their child
  • Reviewing lessons in advance when needed
  • Supervising usage
  • Ensuring content aligns with family values

iMasterly LLC is not responsible for parental decisions regarding suitability.

4. PSYCHOLOGY & EMOTIONAL LEARNING DISCLAIMER

8. AI-GENERATED CONTENT DISCLAIMER

iMasterly uses artificial intelligence to generate lessons, responses, and explanations. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • AI output may occasionally be inappropriate or incomplete
  • No human reviews each lesson before delivery

9. THIRD-PARTY SERVICES

iMasterly uses third-party providers for:

Your use of the Service may also be governed by these third-party providers' terms and privacy policies. iMasterly LLC is not responsible for third-party actions or data practices.

10. ELIGIBILITY & PARENTAL RESPONSIBILITY

  • Children under 13 require parental consent and account creation by a legal guardian (COPPA compliance).
  • Parents must supervise all minor usage.
  • Parents guarantee the accuracy of information provided about their child.
  • Adults may use the Service independently.

11. ACCOUNT SECURITY

You agree to:

  • Maintain confidentiality of login credentials
  • Not share accounts outside your household
  • Notify us of unauthorized access
  • Ensure the accuracy of account information

12. SUBSCRIPTION, BILLING & CANCELLATION

  • Subscription fee: $5.00 USD per month
  • Free Trial: First month free
  • Recurring billing begins after the trial
  • Cancel any time; access remains until billing cycle ends
  • No refunds for partial billing periods
  • Billing disputes must be sent to support@imasterly.com

iMasterly LLC may change prices with 30 days notice.

13. DATA RETENTION & DELETION

Upon a valid request for account deletion:

  • Personal data is deleted or anonymized within 30 days
  • Aggregated or non-identifiable data may be retained for research, analytics, or safety purposes
  • Some data may be retained where required by law, fraud prevention, or system integrity

14. EDUCATIONAL OUTCOMES DISCLAIMER

iMasterly does not guarantee any outcomes, including:

  • Grade improvement
  • Test score improvement
  • Behavioral or social changes
  • Emotional/psychological changes
  • Communication improvements

All learning results vary.

15. LIMITATION OF LIABILITY

To the fullest extent permitted by Texas law:

  • iMasterly is provided "AS IS" without warranties of any kind
  • iMasterly LLC is not liable for:
    • Emotional distress
    • Inaccurate content
    • Academic results
    • Misinterpretation of lessons
    • Psychological or communication effects
    • Decisions made based on platform content
    • AI-related inaccuracies
    • Third-party outages

Maximum liability: iMasterly LLC's total liability shall not exceed the amount you have paid in the preceding 12 months.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless iMasterly LLC, its owners, employees, contractors, and affiliates from claims, losses, or damages arising from:

  • Your use of the Service
  • Your child's use of the Service
  • Your violation of these Terms
  • Misinterpretation of content
  • Reliance on AI-generated responses

17. ACCEPTABLE USE

You agree NOT to:

  • Use the Service unlawfully
  • Scrape, copy, or repurpose content
  • Reverse engineer the platform
  • Attempt unauthorized access
  • Share accounts outside your household
  • Misrepresent identity or information

18. INTELLECTUAL PROPERTY

All platform content, software, branding, graphics, and materials are owned or licensed by iMasterly LLC. You may not copy, modify, distribute, or create derivative works without written permission.

19. FORCE MAJEURE

iMasterly LLC is not liable for delays or failures caused by events beyond its control, including:

  • Natural disasters
  • Acts of God
  • War or terrorism
  • Internet outages
  • Hosting provider failures
  • Government restrictions
  • Third-party service interruptions

20. GOVERNING LAW

These Terms shall be governed by and interpreted according to the laws of the State of Texas, USA, without regard to conflict of law principles.

21. DISPUTE RESOLUTION & ARBITRATION

All disputes must follow this process:

  1. Informal resolution attempt (30 days)
  2. Binding arbitration under the rules of the American Arbitration Association (AAA)
  3. Venue shall be Texas, USA

You waive your right to participate in class action lawsuits or class-wide arbitration.

22. MODIFICATIONS TO TERMS

iMasterly LLC may update these Terms at any time. Continued use constitutes acceptance. Material changes will be communicated via email or notice within the platform.

23. TERMINATION

We may suspend or terminate accounts at our discretion, including for:

  • Violation of Terms
  • Abuse or misuse of the Service
  • Fraudulent activity
  • Non-payment

Access ends immediately upon termination.
